I just got back from a very angry and therapeutic drive. “Drive Angry”, I get it now. I’m still livid though. I finally went to go talk to my neighbors about the !!!error: Indecipherable SUB-paragraph formatting!!! just now. Rant Ahead.

!!! UNKNOWN CONTENT TYPE !!!

Kinja'd!!!

The husband answered, hes nice. Then she came to the door, said “I Dont wanna talk to you right now. I did some research on the internet and found no correlation between anaphylactic peanut allergies and exposure to peanut shells.” WUT. YOU DID A GOOGLE SEARCH AND NOW YOU ARE AN EXPERT ENOUGH TO KNOW THAT I WONT DIE FROM EXPOSURE TO THIS!?!?!?

WHAT THE ACTUAL FUCK!!

My mom came with us this time, My mom said “well, squirrels carry disease” she replied with “Well the way I see it, A well fed squirrel is a healthy squirrel” at some point or another I tried to explain how peanut shells are grown by keratin, keratin is a protein and protein causes anaphylaxis and then tried to explain the symptoms of anaphylaxis (Which is asphyxia leading to cyanosis and death if you didnt know). She interrupted me and said “I dont want to talk to you right now”. She might as well have said “I love squirrels, go die in your yard”. Seriously, How much of a nutball is this lady!?!? Thats when I left in a storm screaming “ I’M SORRY IF I WANT TO FEEL SAFE TO GO INTO MY BACKYARD” then went for a spirited drive in my truck.

My mom offered to give them a note from my allergist saying that its dangerous. I can see the feeder from my bedroom window, If I catch them putting out peanuts after they get a note from a medical professional explaining the dangers of what they are doing, I am calling the cops and filing an attempted assault charge.

I have an inalienable right as an american to feel safe on my own property. They have knowledge that I have a life threatening allergy, I have asked them twice now to stop putting them out, they are aware that I have been finding shells in my yard (Video proof below) and they are going to get a note from someone the courts would consider an expert in the field saying what they are doing is potentially lethal to me. If this doesnt stop THEY WILL be hearing from me again and I’m bringing the cops with me this time.

The fact that she’s more concerned about feeding squirrels than the health and safety of others (especially her neighbors) says a lot about her character. What a bitch.

Sorry man, that must feel horrible. Here's the thing. You can't file an attempted assault charge for putting out peanuts on private property, that's a civil matter that doesn't involve Police unless something escalates into another crime. Also, be wary of filing an assault charge on something like that, you might be the one with something getting pinned on you.

I'd also suggest calling non emergency, explaining your situation and having a Police officer talk to them about it to scare them straight.

That said, try not to get too worked up or angry over this. Yes, you need to work to find a solution, I’m not saying you should just ignore it, but if you “make a scene” or say something that might offend them, it won’t help the situation. Remember, you live next to each other, and I seriously doubt they or you will move just because of this incident, which means you’ve got to stay on somewhat decent terms.

I don’t know about the assault charge stuff but you should definitely try to take it up with the County/City in regards to it littering your yard the city could fine them if they don’t stop.

The thing I don’t get is why feed them at all? That does not help wild animals at all, if she thinks she’s helping she isn’t. And are peanuts really the absolutely best thing to feed squirrels? A nut not commonly found out in the wild way out of their usual diet? Just seems stupid all around.

This. Call the police (not 911) and ask if they can send someone out to arbitrate the dispute. Have your paperwork in order (doctors notes, etc). It’s clear that the neighbor doesn’t respect your authority, so perhaps they need an external authoritative figure to shape them up

That sucks bro, but I doubt that you have any legal recourse against your neighbors. Obviously it would be very easy for them to just stop feeding the squirrels peanuts, but the fact that they themselves are not putting the peanuts in your yard, nor do they actually own the animals that are spreading them, leaves the cops with little to go on. A lawyer may be of some help, but you can’t really legally stop someone from putting peanuts out in their own yard.

Keratin is the main protein component of fingernails and hair and the outer layer of your skin. It is also present in the structure of your mouth muscles . It does not cause your allergic reaction. It’s probably Filaggrin, which is supposed to bond to the Keratin in your skin, that may cause your reaction.

Also, physical contact with peanut dust or residue hasn’t been shown to cause anaphylaxis, only skin rashes.

I think you’re blowing this out of proportion. Have you tried offering to buy sunflower seeds or other squirrel treats for them?

I also have dogs that like to get into things. Hypothetically lets say my dog gets into the peanuts in our yard and without me knowing, then licks my face and lips, thats where the situation gets dangerous. I am also anaphylactically to sunflower seeds, so that isnt an option

Assuming you’re not blowing this out of portion, you need to lawyer up. Simple as that. Cops aren’t likely to do much, sine they have just as much right to feed squirrels on their property as you do to not have peanut shells in your yard. And you need to have that lawyer serve a notice to them from your doctor about the situation. Having a third party review and deliver these papers, and especially a bonded and licensed lawyer, is going to mean more than you showing some video and claiming you gave them notice. A law office is going to have more credibility than you in a court of law and in front of the law (cops). It’s easy to assume you fabricated this “proof”; but not the same with a law office.

Maybe you can find something you’re not allergic and give it to them to feed. I know we’re not suppose to feed wildlife but I find myself doing the same. My reasons are that I’m a little inflamed that people are bulldozing over their natural habitat and the animals that are left are just looking to survive.

Not much more really. As long as it isn't pre-meditated and they are holding some sort of weapon. In this case, a peanut could be considered a weapon, since it could kill those allergic to them.

Peanuts are not particularly good for squirrels. They’re legumes, not nuts, and as such are not part of a squirrel’s normal diet. They contain very little nutrition that meets a squirrel’s needs. Peanuts can actually be very dangerous for squirrels; the shells are likely to contain a mold that is quite toxic to small creatures (same goes with corn). A cursory Google (which she seems adept at) will corroborate the previous statements.

If your neighbor is truly interested in keeping her squirrels healthy and happy, she’d stop killing them with peanuts. Squirrels are herbivores; feed them vegetables and give ACTUAL NUTS in moderation. Nuts are like desserts for squirrels; they’re great for chewing exercises and keeping teeth healthy but should only be fed in moderation. Otherwise the squirrel will not get the nutrition it needs and will become a fat lazy American rodent.

To wit, the peanuts may not kill you, but they are certainly killing the squirrels.

It’s a little deeper than that. He has a documented life-threatening allergy, and the actions his neighbors are performing on their own property are spilling over into his. If it was restricted to their yard, yes, you would have a point. This is like me making my neighbors pay for tree clearing because the limbs were crossing over to my property line and messing with my internet. Which I did. And it was glorious.

Jeeeziz. You got hit with everything. I would hate to have a food allergy but wouldn’t mind giving up sunflower products.

Unfortunately I think until you have a reaction you may not have any legal recourse to make them stop. I think a court will see your neighbors feeding squirrels and the squirrels leaving shells on your property as two different situations.

Find and call a lawyer and ask if there is any action you can take. Any reputable lawyer will let you know if you have any avenue for making your neighbors stop without charging you.

This.

Assuming it’s as big a deal as it sounds, go talk to a lawyer. Cops will probably do nothing as it doesn’t look like any laws are being broken.

If you find the right lawyer he or she will know how to deal with bad neighbor situations. Just like when a tree falls in somebody else’s yard and the “owner” doesn’t want to pay for removal.

Check this out:

You may have a case. I would serve them with papers without regard, personally. Fuck em.

It’s funny I posted something similar about the squirrels eating stuff that’s not a part of their diet and definitely not found in the wild. I forgot about the part that peanuts are not actually nuts.

This neighbor of his is actually nuts. He should call the county/city, in NYC we have 311 so if a street light is out or even if your neighbor is littering on your property they deal with that. He should reach out to them and not the cops or even the EPA which will come and fine you if they think you are doing something wrong regarding wild animals or even if you decided to chop a public tree down without a permit.

You’re a bigger man than I. “Go die in your yard” is approximately the point where the police and an ambulance would need to be called and I would have to be forcibly removed. I’m a fairly calm and level headed fellow, but once my blood gets boiling all bets are off.

That said, now is the time to bring in the law, it’s officers, and whatever else you can. It’ll be tough considering what they do on their property is their choice, so long as it’s not illegal. But knowingly putting someone’s life at risk is a grey area that can/should be addressed by people in power.

Cops won’t do anything, they’re not breaking any standard law. If you want to take this into the system you’d do it via filing a civil nuisance suit same as if they had noxious fumes emanating from the property or excessive brush growth creating a snake problem or something. Then, if the judge grants an injunction and they violate it (after going a couple more rounds in the courts), you can have the cops enforce the injunction and/or file for civil damages.
